    The Department of Organization of Medical Care and Sanatorium Business of the Ministry of Health of the Russian Federation has considered the appeal on the issue of classifying certain services as medical services and reports the following.
    Please note that clarifications of a government body have legal force if this body is endowed, in accordance with the legislation of the Russian Federation, with special competence to issue clarifications on the application of the provisions of regulatory legal acts.
    The Russian Ministry of Health is not vested with the competence to clarify the legislation of the Russian Federation by current legislation. At the same time, we believe it is possible to note the following.
    According to paragraph 10 of Article 2 of the Federal Law of November 21, 2011 N 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation” (hereinafter referred to as Federal Law N 323-FZ), medical activity is the professional activity of providing medical care, conducting medical examinations, medical examinations and medical examinations, sanitary and anti-epidemic (preventive) measures and professional activities related to transplantation of organs and (or) tissues, circulation of donor blood and (or) its components for medical purposes.

At the same time, medical activities are carried out in accordance with the procedures for providing medical care and on the basis of standards of medical care.
    According to the Federal Law of 04.05.2011 N 99-FZ “On licensing of certain types of activities”, medical activities (with the exception of the specified activities carried out by medical organizations and other organizations included in the private healthcare system on the territory of the Skolkovo innovation center) are subject to licensing.
    The range of medical services was approved by order of the Ministry of Health and Social Development of Russia dated December 27, 2011 N 1664n and includes the medical service “Depilation” with service code A14.01.012 and the medical service “Epilation” with service code A14.01.013, at the same time the service “waxing” ", "sugar hair removal (sugaring)" are not included in the specified nomenclature.

    Thus, laser hair removal is a medical service subject to licensing. Liability is provided for under Art. 14.1 Code of Administrative Offenses of the Russian Federation.
