  • If a public holiday falls on a Saturday or Sunday, the day off is transferred to the next working day. In 2017, National Unity Day (4 November) falls on a Saturday, so the holiday moves to Monday 6 November.

    Government Russian Federation has the right to make changes to the production calendar, shift two days off from those that coincide with non-working days holidays January 1-8, on other dates in order to rationalize the labor process (Part 2 of Article 112 of the Labor Code of the Russian Federation). Therefore, for 2017 the following transfers of weekends have been approved:

    • from Sunday January 1 to Friday February 24;
    • from Saturday 7 January to Monday 8 May.

    Pre-holiday days

    On the eve of official state holidays, working hours are reduced by 1 hour, the same for both a 40-, 36- and 24-hour five-day working week (Part 1 of Article 95 of the Labor Code of the Russian Federation). If a holiday falls on a Sunday, the work hours on Friday are not reduced. In 2017, there are 3 such pre-holiday days in Russia: February 22, March 7 and November 3.

    The duration of a working day or shift with a 40-hour work week with two days off on Saturday and Sunday is 8 hours, with a 36-hour work week - 7.2 hours, with a 24-hour week - 4.8 hours, on a holiday day it decreases by 1 hour .

    According to the Russian labor calendar, in 2017 the country has 247 working days (including 3 shortened days) and 118 days off.

    How to create a production calendar for 2017

    The production calendar for 2017 is drawn up taking into account the following rules.

    Under Article 112 Labor Code In the Russian Federation, non-working holidays (weekends) are considered to be:

    • January 1, 2, 3, 4, 5, 6 and 8 – New Year holidays;
    • January 7 – Christmas;
    • February 23 – Defender of the Fatherland Day;
    • March 8 – International Women's Day;
    • May 1 – Spring and Labor Day;
    • May 9 – Victory Day;
    • June 12 – Russia Day;
    • November 4 is National Unity Day.

    If a day off coincides with a non-working holiday, the day off is transferred to the next working day after the holiday.

    The production calendar for 2017 was also compiled taking into account additional transfers New Year's holidays. The fact is that Federal laws or the Government of the Russian Federation may establish a special procedure for postponing holidays when they coincide with weekends (for example, for the New Year holidays). This follows from the provisions of parts 2 and 5 of Article 112 of the Labor Code of the Russian Federation. In 2017, January 1 and January 7 fell on weekends. The additional weekends resulting from this will be moved as follows: from January 1 to February 24, from January 7 to May 8.

    In addition to all-Russian regional legislation, additional non-working holidays (weekends) may be established (Part 1 of Article 6 of the Labor Code of the Russian Federation, Resolution of the Presidium of the Supreme Court of the Russian Federation dated December 21, 2011 No. 20-ПВ11).

    As a rule, the standard working time for certain periods of time is calculated according to a five-day work week with two days off (a day off on Saturday and a day off on Sunday) based on the following duration of daily work (shift):

    • with a 40-hour work week, eight hours;
    • when the working week is less than 40 hours, the number of hours obtained by dividing the established working week by five days.

    On the eve of non-working holidays, working hours are reduced by one hour (Article 95 of the Labor Code of the Russian Federation).

    Deadlines for submitting reports in the 1st quarter of 2017

    SZV-M for December 2016 is the first report that accountants will submit in 2017. After SZV-M you need to submit information about the average number of employees. Submit this report even if the number of employees as of January 1, 2017 is “0” people. Only individual entrepreneurs without employees are exempt from zero reporting.

    Submit 4-FSS on paper by January 20; you can submit an electronic payment by the 25th. Will be in effect in 2017 new form 4-FSS. But for the report for 2016, take the old form approved by FSS order No. 59 dated February 26, 2015.

    IN Labor Code of the Russian Federation the possibility of reducing the duration of the working day is clearly and clearly defined, provided that it is the last one before a holiday non-working day. On May 1, 2017, all Russians will celebrate Labor Day, which is public holiday and weekends. It falls on a Monday and is preceded by two regular calendar days. In this regard, the question arises - is the working date that precedes them, April 28, a short day or not? Let's look at this in more detail.

    Why is April 28, 2017 not a shortened day?

    Since April 28, 2017, Friday, does not directly precede the non-working holiday - Monday, May 1, it does not become shorter by 1 hour. It is provided for a duration of 8 hours, as for all other workdays. As for shortened working hours, in accordance with the production calendar, there are only three such dates in 2017:

    • February 22 - before the holiday February 23;
    • March 7 - before the holiday March 8;
    • November 3 - before the holiday November 4.

    Thus, April 28th is among them in this calendar year is not included, since in all other cases the dates before the holidays coincided with regular official weekends, so they did not in any way affect the length of working time.     What is said in the Labor Code

    The procedure for establishing shortened working days is regulated; traditionally, it is its norms that apply to the production calendar for 2017 and all previous and subsequent years. From its text it follows that:

    The length of the working day or shift immediately preceding a non-working holiday is reduced by one hour.

    Separately, it is necessary to note the very definition of “pre-holiday days”, which is given in the text of Article 95 of the Labor Code of the Russian Federation. According to it, such a day is the date on the calendar that immediately precedes the holiday. Thus, if the pre-holiday day of April 28 was immediately before May 1, then it should have been shorter by 1 hour for all employees Russian organizations and entrepreneurs who work according to a standard schedule: five days a week, 8 hours. If there is an irregular work schedule, for example, when an organization operates in a continuous cycle or the enterprise carries out activities in which reducing the duration of a shift on a pre-holiday day is impossible, the employer must compensate its employees for overtime for such a shortened day. The employee must agree with the method of compensation offered by the employer. It could be:

    • additional rest time;
    • payment according to the standards established by law for overtime(double salary or tariff rate).

    If an organization operates on a six-day work week, then the shortened working day will also be shortened by one hour, and the total working time on Saturday cannot always exceed 5 hours.

    Some employers give employees the opportunity to leave work an hour earlier on Fridays. There is no such provision in the legislation and this is a personal initiative of the organization’s management. This mode of operation should be enshrined in internal regulations and should not in any way affect wages. By the way, for a shortened pre-holiday day, wages must also be paid in full, as for 8 hours worked. Even those workers who are paid hourly. Unfortunately, all these norms have nothing to do with April 28th.

    In accordance with the Procedure, approved. By Order of the Ministry of Health and Social Development of Russia dated August 13, 2009 N 588n, the standard working time is calculated depending on the established duration of working hours per week according to the calculated schedule of a five-day working week with two days off on Saturday and Sunday based on the duration of daily work (shift). So, with a 40-hour working week, the standard working time is 8 hours, with a working week of 36 hours it will be 7.2 hours, with a 24-hour working week - 4.8 hours.

    In accordance with Part 1 of Article 95 of the Labor Code of the Russian Federation, the duration of the working day or shift immediately preceding a non-working holiday is reduced by one hour. In 2017, employees will work one hour less on February 22, March 7, and November 3.

    The standard working time calculated in the specified order applies to all work and rest regimes.
